Our Terms and Conditions
1. Our Services:
We provide the following services:
Framing of memorabilia, jigsaw, prints and posters, photographic works, craftwork and fine art (“artworks”). We also do general repairs, cleaning and specialist frame and artwork restoration work.
We are art lovers and we are proud of our work!
2. Pricing:
We will consult with you on the best way to present, and preserve, your treasured artworks, and once we have both agreed on the services to be performed, we will confirm the price with you for all the work to be done and the services to be provided prior to commencing any work.
All prices for framing services are provided upfront and are subject to change without notice.
Additional charges may apply for rush orders, custom designs, or specialty materials.
Additional charges may also be applied where you request changes after work has started on an agreed design.
3. Payment:
Payment is due in full upon completion of the services on collection of your artwork.
We accept cash, credit/debit cards, and electronic payments.
For all work submitted to us for our services, including custom orders and specialist services, a deposit of 25% will be required up front prior to us accepting your artwork into our custody and care.
The balance of the amount payable shall be due in full on collection.
We reserve the right to charge interest on overdue amounts at a rate of 10% of the balance outstanding on any invoice after 30 days.
4. No Liability for Artwork in Our Custody and Care:
We will make every effort to handle your artwork with due care and skill, however, you agree that we are not responsible for any damage to your artwork while it is in our custody and care, and you assume all risks associated with framing, mounting, restoring and any other services that you engage us to perform relating to your artwork, and this includes damage that may occur in the course of performing the services, despite our best efforts.
We will make every effort to transport your artwork with due skill and care, including using packing and protective materials, where this is a necessary part of the provision of the services, however, you agree that you assume all risks associated with the transit by us of your artwork from, including from our storage area to our worksite, and any transit related to collecting the artwork from you or delivering back to you at the completion of the services.
We may ask to sight a certificate of currency of insurance relating to the artworks before agreeing to accept any artworks into our custody and control, or before agreeing to perform any services on that artwork where that we reasonably believe it may have a market value over $10,000.00.
5. Artwork Collection:
All framed artworks must be collected up within 30 days of completion. After 30 days, a storage fee may be applied, and if artwork is not picked up within 90 days, it may be considered by us as having been abandoned and shall be dealt with at our sole discretion. All abandoned goods will be dealt with in accordance with the provisions of the Australian Consumer Law and Fair Trading Act 2012 (Vic)
Title to the artworks vests with us until full payment is made and we shall have a possessory lien on artworks provided to us for the provision of the services, including all materials used and applied, and we may sell artworks under this lien by public auction or private sale to recoup outstanding amounts owed to us.
6. Turnaround Time:
We will use our best endeavours to complete the services in a timely manner by the agreed date for completion. However, you acknowledge that there are many variables which affect the performance of the services and turnaround times may vary depending on the complexity of the work, current workloads and the availability of your preferred materials.
You accept that you will have no claim for loss, or a price reduction, if the agreed date is not met and any delay in the provision of the services that is outside of our control will not be considered sufficient grounds for cancelling the services, or for any price reduction, or refund of deposit monies paid.
7. Quality Guarantee:
We guarantee the quality of materials and workmanship used in performing all of our services. If you are not satisfied with the finished result, we will work to resolve the issue to your satisfaction.
8. Copyright:
Your warrant that you have the legal right to reproduce any artwork provided to us for the provision of our services. We assume no liability for copyright infringement.
9. Title:
Your warrant that you have the legal right and title to the artwork. We assume no liability to any third party where artwork provided to us for the provision of our services is altered in any way without the true owner’s knowledge, authority or consent.
10. Indemnity:
To the fullest extent permitted by law, you agree to indemnify us and keep us indemnified against all claims for any loss, liability arising directly or indirectly or consequentially as a result of or in connection with the provision of the services, including any claim by a third party on any grounds whatsoever.
11. Privacy Policy:
Any personal information collected from the customer will be kept confidential and used solely for the purpose of providing framing services.
12. Modification of Terms:
These terms and conditions may be modified at any time at the discretion of the picture framer. Updated terms will be posted on our website or provided to customers upon request.
13. Governing Law and Jurisdiction
These terms and conditions and any disputes or claims arising out of or in connection with them are governed by, and shall be construed in accordance with, the laws of Victoria, Australia.
By engaging our services, and by providing your artwork to us, you acknowledge that you have read, understood and agreed to the terms and conditions outlined above.
